The Assin Kyekyewere Circuit Court has cleared three men accused of attempted robbery, ruling that the prosecution failed to present enough evidence to support the charges against them.
In her judgment, Her Honour Dora G.A. Nkumsah Eshun upheld a submission of no case to answer, concluding that the prosecution had not established a prima facie case warranting the accused persons to enter a defence.
The court found that the evidence presented lacked sufficient probative value to justify proceeding with the trial.
The accused,Godwin Kwabena Mensah, 28, Kwadwo Frimpong, 20, and Kwabena Antwi, 30, were arrested during an intelligence-led operation conducted by the Central North Regional Police Command.
They had been linked to an alleged armed robbery attack that took place around 1:00 a.m. on June 25, 2025, at Assin Ntow-Krom in the Assin North District.
Police alleged that a group of five armed men stormed the residence of a gold dealer and farmer, wielding machetes and a locally manufactured three-barrel pump-action gun.
During the incident, one of the victims, Kwabena Amos, reportedly suffered severe injuries, including a machete wound and significant facial trauma after allegedly being struck with the butt of a firearm. The attack is said to have caused serious damage to his right eye.
His brother, Richard Kumah, reportedly escaped without injury.
Investigators further claimed that the suspects had visited the community beforehand, posing as job seekers while conducting surveillance ahead of the alleged robbery.
Following the prosecution’s case, defence lawyers filed a submission of no case to answer, arguing that the evidence presented was insufficient to require the accused persons to respond to the charges.
After examining the evidence, the court agreed with the defence and acquitted and discharged all three men.
The decision has sparked disappointment among the victims and their relatives, who have expressed dissatisfaction with the ruling.
They have indicated plans to petition the Attorney-General to review the case and explore additional legal avenues in their pursuit of justice.
