The suspended Chief Justice, Mrs. Gertrude Torkornoo, is seeking $10m in damages from the government of Ghana at the Community Court of Justice of ECOWAS in Abuja, Nigeria.
A main application filed by Mrs Torkornoo said the USD 10 million is being sought as compensation for “moral and reputational damages suffered by her as a result of her illegal suspension and unfair investigation”.
According to a report by State-owned media, GBC, the suit was filed on behalf of Justice Torkornoo, by Nigerian law firm, Femi Falana San of Falana & Falana Chambers, at the Registry of the Community Court of Justice of ECOWAS.
Mrs Torkornoo, according to the report, has filed two applications at the Court; a main application and another for provisional measures. Both applications were filed on Friday, July 4, 2025.
Another relief being sought by the suspended Chief Justice is a declaration that her “purported suspension as the Chief Justice of the Republic of Ghana by the President on 22 April 2025, constitutes a violation of her human right to fair equitable and satisfactory conditions guaranteed by Article 15 of the African Charter on Human and Peoples’ Rights”.
In the application for provisional measures, Mrs. Torkornoo is requesting the Court to direct the Republic of Ghana to suspend the disciplinary/removal from office as Chief Justice process against her, pending the hearing and determination of the complaint on the merits.
Additionally, she is praying the Court to rule that the country ensures she “continues to enjoy the paraphernalia and entitlements of her office as the Chief Justice of Ghana pending the hearing and determination of the case.”
